Two-year limited warranty

Brooks warrants that products it manufactures will be free from defects in material and workmanship for two years from the date of purchase, when used in accordance with applicable instructions. Within that period Brooks will repair or replace a defective product at its discretion. Repair or replacement is the sole and exclusive remedy under this warranty.

Who is covered

This warranty runs to the original purchaser of the product and is not transferable. An invoice or receipt from Brooks establishes the purchase date.

What is not covered

This warranty does not cover normal wear, or damage resulting from accident, misuse, abuse or neglect. It does not cover damage caused by improper installation, by operation outside the product's stated rating, or by a fault in the supply to which the product is connected. It does not apply to any product that has been modified, repaired or opened by anyone other than Brooks. Cosmetic damage that does not affect how the product functions is also excluded.

A surge protective device that has absorbed a transient and shows reduced suppression has performed as designed. Degradation of a suppression component through use is not a defect in material or workmanship.

Products Brooks does not manufacture

Brooks supplies some products that it does not manufacture. Each carries the original manufacturer's warranty; contact Brooks and we'll handle the claim. The quotation and the order acknowledgment state which warranty applies to a given product.

Suitability

The customer is responsible for determining whether a product is suitable, adequate and safe for the intended use. Because applications vary widely, Brooks makes no representation or warranty as to the fitness of any product for a specific application. This applies whether the product is a standard catalog model or is built to a specification the customer supplied.

Making a claim

Contact Brooks before returning a product. Brooks issues a Return Material Authorization number by email, with shipping instructions. An RMA number is valid for 30 days from the date of issue, and a product received without a valid RMA number is not accepted. Return the product with the RMA number marked on the outside of the package, a description of the fault, and proof of purchase where requested. Who pays for shipping depends on the reason for the return:

• Covered by this warranty: the customer prepays shipping to Brooks, and Brooks pays to ship the repaired or replacement product back.
• Brooks shipped the wrong product, or one that does not match the accepted specifications: Brooks pays shipping both ways.
• Not defective, or not covered by this warranty: the customer pays shipping both ways.

Limitations

THIS WARRANTY IS THE ONLY WARRANTY BROOKS MAKES. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED. BROOKS EXCLUDES ALL INCIDENTAL AND CONSEQUENTIAL DAMAGES.

How this warranty relates to the terms

This warranty forms part of the terms, which set out governing law and the order in which documents take precedence. The supplying entity is BROOKS POWER SYSTEMS, LLC, doing business as Brooks Custom Power Solutions. Please direct all questions to sales@brookspower.com.
